TERMS OF SERVICE

The supplier, Frogster Interactive Pictures AG - represented in the forums by the administrators - offers free web content to a community of users. The following terms of service apply to all community content, and by registering, all users agree to be legally bound to these terms of service.

All members are called upon to check on content made accessible to them on the community pages. The administrators will not be able to check content in advance, unless this content is provided by Froster-Interactive itself. If they become aware of them, the adminstrators will edit or delete postings that infringe on existing criminal and press laws of the Federal Republic of Germany and/or are objectionable. This includes illegal content as well as obscene, offensive, and harassing behaviour and links to objectionable content of this kind. Under no circumstances will Frogster Interactive Pictures AG support the incitement to or instigation of illegal acts. For instance, but by no means exclusively, the following behaviour is expressly prohibited:

• The transmission or promulgation of graphics, images, texts, or full web pages with pornographic, national socialist, racist, or other content that infringes on existing laws of the Federal Republic of Germany or that the suppliers may deem offensive to others.
• The promulgation of content inciting hatred against parts of the population ("incitement of the people") or propagating unconstitutional organisations, as well as the publication of addresses and phone numbers of third parties with the intent of exposing them against their will is also prohibited.
• The forum constitutes a service to facilitate the exchange between many different communities of people. It is our aim to offer all members an interesting and exciting space for communication. The use of obscene, abusive, or hateful language undermines this goal and is therefore not permitted. Please conduct yourself according to "netiquette" and be polite towards others, then they will treat you politely as well.
• Behaviour will be deemed to be of a harassing nature if a member contacts another in order to give them unwanted attention or to discomfort them in any way. Frogster Interactive Pictures AG will not tolerate the harassment of members, regardless of the way it occurs. Therefore, it reserves the right to suspend, limit, or terminate without notice the membership of any user harassing other users.
• Instances of identity fraud include the impersonation of individuals or legal entities and the use of registered trade marks. This also includes the impersonation by users of employees of Frogster Interactive Pictures AG or of suppliers, hosts, or another third person with a name different from their own. It particularly pertains to the choice of screen names ("nick names") or user profiles, as well as to dialogue in the separate forums.

Violations of the above-mentioned codes of conduct are prohibited. If you witness a communication in a forum that violates the terms of service, you are asked to notify the forum administrators via email.

The placement of advertisement in any form whatever (graphics, links, etc.) without prior express written consent by the supplier is not permitted and not acceptable under any circumstances. Infringement of this rule can lead to the immediate termination of membership. Inadmissible advertisements of this kind will be removed immediately. Should such illegally placed advertisement moreover infringe on existing laws of the Federal Republic of Germany, the supplier reserves the right to take legal action.

Domestic authority rests with the administrators and moderators of the community area. In the case of the above-mentioned offences or in the case of users who seem to disturb the peace in and the reputation of the community or to offend moral values, the administrators and moderators can lock or delete the relevant postings and/or warn or block the respective user. The decision in favour of such intervention and its form rests with the moderator/adminstrator. Frogster Interactive Pictures AG reserves the right to delete postings and names that violate general rules of conduct or the above-mentioned points. In the case of grave violations of the above-named conduct in particular and of netiquette in general, users' membership can be limited and/or deleted without notice.

Frogster Interactive Pictures AG is entitled to send a newsletter and other community-related and relevant information to the email address supplied during the registration process. Frogster Interactive is fully committed to adhering to the privacy laws of the Federal Republic of Germany and will not disclose the email addresses or other data of registered users to third parties. This does not apply if a user chooses to configure their profile in such a way as to make their email address visible to other users. Membership accounts and logged data will be deleted on request via email as quickly as possible in the course of regular deletion intervals. The user's nick name, however, will then not be available to them any longer, and following a deletion request, users should not attempt to log in to their account any more.
